Welcome to Paradise Keys. These Terms of Service ("Terms") govern your use of our vacation rental and property management services in Koh Samui, Thailand. By accessing or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

2. Description of Services

Paradise Keys provides the following services:

  • Vacation rental property listings and bookings
  • Property management services for owners
  • Guest services and support
  • Property maintenance and cleaning
  • Marketing and advertising services
  • Financial management and reporting
  • Guest communication and support

3. User Accounts

3.1 Account Creation

To use certain features of our services, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

4. Property Bookings

4.1 Booking Process

  • All bookings are subject to availability and confirmation
  • Payment is required at the time of booking unless otherwise specified
  • Booking confirmations will be sent via email
  • Guests must provide valid identification upon check-in

4.2 Cancellation Policy

  • Free cancellation: Up to 24 hours before check-in
  • Partial refund: 50% refund for cancellations within 24 hours
  • No refund: For no-shows or same-day cancellations
  • Special cancellation policies may apply during peak seasons

4.3 Check-in and Check-out

  • Check-in time: 3:00 PM (15:00)
  • Check-out time: 11:00 AM (11:00)
  • Early check-in or late check-out may be available upon request
  • Additional fees may apply for early/late times

5. Property Management Services

5.1 Owner Responsibilities

  • Provide accurate property information and documentation
  • Maintain property in good condition
  • Comply with local laws and regulations
  • Provide access for maintenance and cleaning
  • Pay management fees as agreed

5.2 Our Responsibilities

  • Market and advertise your property
  • Handle guest bookings and communications
  • Coordinate cleaning and maintenance
  • Provide financial reporting
  • Ensure guest satisfaction

5.3 Management Fees

Management fees are typically 15-25% of gross rental income, depending on the level of service required. Specific fees will be outlined in your property management agreement.

6. Payment Terms

6.1 Payment Methods

  • Credit cards (Visa, MasterCard, American Express)
  • Bank transfers
  • PayPal
  • Cryptocurrency (Bitcoin, Ethereum)

6.2 Payment Processing

  • All payments are processed securely
  • Currency conversion rates apply for international payments
  • Payment confirmations are sent via email
  • Refunds are processed within 5-10 business days

6.3 Security Deposits

Security deposits may be required for certain properties. Deposits are held securely and returned within 7 days after check-out, minus any damages or additional charges.

7. Guest Responsibilities

  • Respect the property and neighbors
  • Follow house rules and local regulations
  • Report any damages or issues immediately
  • Maintain reasonable noise levels
  • No smoking in non-smoking properties
  • No pets unless specifically allowed
  • Maximum occupancy limits must be respected
  • Proper disposal of waste and recycling

8. Prohibited Activities

The following activities are strictly prohibited:

  • Illegal activities or drug use
  • Excessive noise or disturbances
  • Property damage or vandalism
  • Subletting or unauthorized guests
  • Commercial activities without permission
  • Violation of local laws or regulations
  • Harassment of neighbors or staff
  • Use of property for events without approval

9. Limitation of Liability

To the maximum extent permitted by law, Paradise Keys shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Property damage or personal injury
  • Travel delays or cancellations
  • Weather-related issues
  • Third-party services or products

Our total liability shall not exceed the amount paid for the specific service in question.

10. Intellectual Property

All content on our website and in our services, including text, images, logos, and software, is protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content
  • Use our trademarks without permission
  • Reverse engineer our software
  • Create derivative works

11. Privacy

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Thailand. Any disputes will be resolved in the courts of Thailand.

12.2 Mediation

Before pursuing legal action, parties agree to attempt mediation through a mutually agreed mediator in Koh Samui, Thailand.

13. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or other force majeure events.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the modified Terms.
